No Child Left Behind The No Child Left Behind (NCLB) Act of 2001 is federal legislation passed in 2002 aimed at having all public school children performing at grade level in reading and mathematics by 2014. DC Schools for Improvement Under No Child Left Behind, students attending schools that need improvement must be given the opportunity to transfer to a better-performing public school in the school district. In addition, Supplemental Educational Services, such as after-school tutoring or academic summer camps, must be made available to students from low-income families who attend schools that have been in need of improvement for more than a year. Identification of Persistently Dangerous Schools
and the Unsafe School Transfer Option
The District of Columbia Board of Education amended Chapter 38 of the Board Rules, Title 5 of the District of Columbia Municipal Regulations to comply with the requirements of Title IV of NCLB. The amendment stipulates that a school will be designated as persistently dangerous if the annual number of officially reported violent crimes against students on the school grounds during school hours over a period of two consecutive years is equal to or greater than:

• five (5) for schools with enrollments of 500 students or less; or

• 1% of the school’s official membership for schools with enrollments of 501 students or more.

The amendment also provides for an individual student victim transfer option if the student has been a victim of a violent crime committed on school grounds, during school operating hours, that has been substantiated by the LEA; or a victim of a pattern of harassment or sexual harassment perpetrated on school grounds during school hours that has been substantiated pursuant to the filing of a grievance.
